Ways of winning your Speeding Ticket without a qualified agent

When you go to court by yourself, or unrepresented your odds of winning your case are reduced dramatically. You really only have two ways of winning your ticket and only upon the whim of the court that they don’t challenge you or the situation.


1. The officer doesn’t appear at court

Although most times the case will be dropped because of the officer not showing up, the Prosecutor can ask the court to remand your case to another day to allow the officer to appear.  If you do not make an objection to the Prosecutors motion, and explain why the motion should not be granted the Justice of the Peace may grant the request to the Prosecutor thereby losing the opportunity to win your case. 2. A fatal error on the ticket

Before entering a conviction the Justice of the Peace is suppose to examine the certificate (speeding ticket) for errors.  If the Justice of the Peace finds a fatal error on the ticket he is suppose to “Quash” the certificate. If the Justice of the Peace misses the fatal error he will register a conviction. A qualified court agent from Ontario Traffic Tickets would be able to identify the fatal error and if need be point it out to the Justice of the Peace.

You may be able to win your case if you have the skill and knowledge to conduct a trial in your own behalf.  If you understand what a motion for non-suit is, what the fatal errors are, what the proper set fine is, how to oppose a crown motion, and you have access to case law to review and present to the court then your probably qualified.  If you don’t know what these legal terms are your not going to win your ticket.  Being penny wise make you pound poor!

Taking a Reduced Charge to your Speeding Ticket

When you appear in traffic court the prosecutor may offer you a reduced charge to the speeding ticket.  Before you accept any reduced charge make sure you understand all of the ramifications of accepting a plea bargain.

First do you know what the ramifications of the reduced charge to the speeding ticket are?  Some reduced charges have no benefit at all.  Some speeding tickets have a hidden licence suspension.  Are there still demerit points? Will the reduced charge to speeding affect your insurance? The defendant may have been wiser to have a trial than accept a worthless plea bargain.  Is the prosecution offering the plea bargain because they know that they can’t prove the charge?  Is there something wrong with the prosecutor’s case?

The prosecutor is at the court to get convictions. They are not there to provide guidance or to help you with your speeding ticket.  It is not the prosecutor's job to help you. The prosecutor as the name implies is there to prosecute you, It's their job to convict you of the charge.  

If you come to court unrepresented and don’t know the law do not expect the prosecutor to be your friend and to help you win your case.

When you have a qualified person appearing for you in traffic court you get every opportunity of winning your ticket completely.  An agent from Ontario Traffic Tickets will be a person known to the prosecutor as someone that they cannot bluff or mislead in any way.  The agent of Ontario Traffic Tickets will ensure if there is anyway of having the ticket dropped that they will find it.  If there is a resolution or plea arranged it will be one that has a direct benefit to the client and not to the court.
